合同会社Nonagon Capital（以下「当社」といいます。）は、当社が提供するサービス（エージェンティック決済ゲートウェイ「Nonagon Link」を含みます。以下「当社サービス」といいます。）の利用者（以下「利用者」といいます。）の個人情報について、以下のとおりプライバシーポリシー（以下「本ポリシー」といいます。）を定めます。本ポリシーは、当社がどのような個人情報を取得し、どのように利用・共有するか、利用者がどのようにご自身の個人情報を管理できるかをご説明するものです。

第1条（個人情報）

「個人情報」とは、生存する個人に関する情報であって、次のいずれかに該当するものをいいます。

• 当該情報に含まれる氏名、生年月日その他記述等により特定の個人を識別することができるもの（他の情報と容易に照合することができ、それにより特定の個人を識別できるものを含む。）
• 「個人情報の保護に関する法律」に定める個人識別符号が含まれるもの

第2条（個人情報の収集方法）

1. 当社は、利用者が利用登録などを行う際に氏名、住所、電話番号、メールアドレス、銀行口座番号などの個人情報をお尋ねすることがあります。また、利用者と提携先などとの間でなされた利用者の個人情報を含む取引記録や決済に関する情報を、当社の提携先（情報提供元、広告主、広告配信先などを含みます。以下「提携先」といいます。）などから収集することがあります。
2. Nonagon Link においては、具体的に以下の情報を取得します。
   • 登録情報: メールアドレス、パスワード（不可逆的にハッシュ化して保存し、平文では保持しません）、表示名、招待コードの利用記録
   • プロバイダー情報: 提供 API のエンドポイント URL・メタデータ、API 認証キー（暗号化して保管します）、出金先の銀行口座情報
   • 決済情報: ウォレットアドレス、ブロックチェーントランザクション署名、決済金額、日時、決済ステータス
   • 技術情報: IP アドレス、Cookie・セッション情報、ユーザーエージェント、アクセスログ

第3条（個人情報を収集・利用する目的）

当社が個人情報を収集・利用する目的は、以下のとおりです。

1. 当社サービスの提供・運営のため
2. 当社サービスに係る契約、履行、解約又は管理のため
3. 利用者からのお問い合わせに回答するため（本人確認を行うことを含む）
4. 利用者が利用中のサービスの新機能、更新情報、キャンペーン等及び当社が提供する他のサービスの案内のメールを送付するため
5. メンテナンス、重要なお知らせなど必要に応じたご連絡のため
6. 利用規約に違反した利用者や、不正・不当な目的でサービスを利用しようとする利用者の特定をし、ご利用をお断りするため（経済制裁リスト（米国 OFAC SDN リストを含みます）に基づくウォレットアドレス等のスクリーニングを含みます）
7. 利用者にご自身の登録情報の閲覧や変更、削除、ご利用状況の閲覧を行っていただくため
8. 有料サービスにおいて、利用者に利用料金を請求し、また売上の精算・出金を行うため
9. 上記の利用目的に付随する目的のため

第4条（利用目的の変更）

1. 当社は、利用目的が変更前と関連性を有すると合理的に認められる場合に限り、個人情報の利用目的を変更するものとします。
2. 利用目的の変更を行った場合には、変更後の目的について、当社所定の方法により、利用者に通知し、または本ウェブサイト上に公表するものとします。

第5条（個人情報の第三者提供）

1. 当社は、次に掲げる場合を除いて、あらかじめ利用者の同意を得ることなく、第三者に個人情報を提供することはありません。ただし、個人情報保護法その他の法令で認められる場合を除きます。
   1. 人の生命、身体または財産の保護のために必要がある場合であって、本人の同意を得ることが困難であるとき
   2. 公衆衛生の向上または児童の健全な育成の推進のために特に必要がある場合であって、本人の同意を得ることが困難であるとき
   3. 国の機関もしくは地方公共団体またはその委託を受けた者が法令の定める事務を遂行することに対して協力する必要がある場合であって、本人の同意を得ることにより当該事務の遂行に支障を及ぼすおそれがあるとき
   4. 予め次の事項を告知あるいは公表し、かつ当社が個人情報保護委員会に届出をしたとき
      1. 利用目的に第三者への提供を含むこと
      2. 第三者に提供されるデータの項目
      3. 第三者への提供の手段または方法
      4. 本人の求めに応じて個人情報の第三者への提供を停止すること
      5. 本人の求めを受け付ける方法
2. 前項の定めにかかわらず、次に掲げる場合には、当該情報の提供先は第三者に該当しないものとします。
   1. 当社が利用目的の達成に必要な範囲内において個人情報の取扱いの全部または一部を委託する場合（クラウドインフラ事業者である Amazon Web Services 等を含みます）
   2. 合併その他の事由による事業の承継に伴って個人情報が提供される場合
   3. 個人情報を特定の者との間で共同して利用する場合であって、その旨並びに共同して利用される個人情報の項目、共同して利用する者の範囲、利用する者の利用目的および当該個人情報の管理について責任を有する者の氏名または名称について、あらかじめ本人に通知し、または本人が容易に知り得る状態に置いた場合
3. Nonagon Link の決済・出金処理に必要な範囲で、決済事業者（Circle Internet Financial 等）に個人情報を提供することがあります。

第6条（ブロックチェーン上に記録される情報）

Nonagon Link の決済に伴い、ウォレットアドレス、取引金額、トランザクション署名等は、Solana 等の公開ブロックチェーン（分散型台帳）上に記録されます。ブロックチェーン上に記録された情報は、その性質上、当社を含む何人も削除・訂正することができません。この点をご理解のうえ当社サービスをご利用ください。

第7条（外国にある第三者への提供）

決済・出金処理のため、米国に所在する Circle Internet Financial 等に個人情報を提供することがあります。提供先の所在国における個人情報保護制度および提供先が講ずる保護措置に関する情報は、第 12 条の窓口までお問い合わせください。

第8条（安全管理措置）

当社は、個人情報の漏えい、滅失または毀損の防止のため、通信の暗号化（TLS）、保存データの暗号化、パスワードおよび当社発行の API キーのハッシュ化、プロバイダー API 認証キーの暗号化保管、アクセス制御、監査ログの記録その他の安全管理措置を講じます。また、当社サービスは、セッション管理、認証および CSRF 防止に必要な Cookie を使用します（広告配信を目的とした Cookie は使用していません）。アクセス解析のための Cookie については、次条をご覧ください。

第8条の2（アクセス解析ツールの利用および外部送信）

1. 当社は、当社サービスの利用状況の把握および改善を目的として、Google LLC が提供するアクセス解析ツール「Google アナリティクス 4」を利用します。
2. Google アナリティクスは、Cookie（_ga 等）を使用して利用者を識別し、 閲覧したページの URL、ページタイトル、参照元、言語設定、端末およびブラウザに関する情報等を収集します。当社は、当該情報が個人を特定しうる情報を含まないよう、送信する URL について、流入元の分析に用いる utm_ で始まるパラメータを除くすべてのクエリ文字列を除去し、ページタイトルをページの種別を示す固定値に置き換え、外部サイトからの参照元をドメイン単位に丸めたうえで送信する設定を行っています。
3. 前項により収集された情報は、Google LLC（米国）に送信され、同社のサーバー（日本国外を含みます）において保存・処理されます。これは、個人情報の保護に関する法律に定める外国にある第三者への個人データの提供に該当するため、当社は、Cookie の利用に関する同意バナーを通じて本人の同意を得たうえで提供します。米国における個人情報の保護に関する制度については個人情報保護委員会の公表情報を、Google が講じている個人情報の保護のための措置についてはGoogle プライバシーポリシーおよびGoogle のデータ処理規約をご参照ください。
4. 利用者は、本サイト各ページの「Cookie 設定」から、いつでも同意を撤回できます。撤回後、Google への送信は停止し、Google アナリティクスの Cookie は削除されます。また、Google が提供するGoogle アナリティクス オプトアウト アドオンをブラウザに導入することによっても、Google アナリティクスによる情報収集を拒否することができます。同意しない場合や同意を撤回した場合でも、当社サービスの利用に支障はありません。
5. 電気通信事業法第 27 条の 12 に基づく公表については、利用者情報の外部送信についてをご覧ください。
6. Google によるデータの取り扱いについては、Google プライバシーポリシーをご覧ください。

第9条（個人情報の開示）

1. 当社は、本人から個人情報の開示を求められたときは、本人に対し、遅滞なくこれを開示します。ただし、開示することにより次のいずれかに該当する場合は、その全部または一部を開示しないこともあり、開示しない決定をした場合には、その旨を遅滞なく通知します。なお、個人情報の開示に際しては、1件あたり1,000円の手数料を申し受けます。
   1. 本人または第三者の生命、身体、財産その他の権利利益を害するおそれがある場合
   2. 当社の業務の適正な実施に著しい支障を及ぼすおそれがある場合
   3. その他法令に違反することとなる場合
2. 前項の定めにかかわらず、履歴情報および特性情報などの個人情報以外の情報については、原則として開示いたしません。

第10条（個人情報の訂正および削除）

1. 利用者は、当社の保有する自己の個人情報が誤った情報である場合には、当社が定める手続きにより、当社に対して個人情報の訂正、追加または削除（以下「訂正等」といいます。）を請求することができます。
2. 当社は、利用者から前項の請求を受けてその請求に応じる必要があると判断した場合には、遅滞なく、当該個人情報の訂正等を行うものとします。
3. 当社は、前項の規定に基づき訂正等を行った場合、または訂正等を行わない旨の決定をしたときは遅滞なく、これを利用者に通知します。
4. 前各項にかかわらず、ブロックチェーン上に記録された情報（第 6 条）は、その性質上、訂正等を行うことができません。

第11条（個人情報の利用停止等）

1. 当社は、本人から、個人情報が、利用目的の範囲を超えて取り扱われているという理由、または不正の手段により取得されたものであるという理由により、その利用の停止または消去（以下「利用停止等」といいます。）を求められた場合には、遅滞なく必要な調査を行います。
2. 前項の調査結果に基づき、その請求に応じる必要があると判断した場合には、遅滞なく、当該個人情報の利用停止等を行います。
3. 当社は、前項の規定に基づき利用停止等を行った場合、または利用停止等を行わない旨の決定をしたときは、遅滞なく、これを利用者に通知します。
4. 前2項にかかわらず、利用停止等に多額の費用を有する場合その他利用停止等を行うことが困難な場合であって、利用者の権利利益を保護するために必要なこれに代わるべき措置をとれる場合は、この代替策を講じるものとします。

第12条（プライバシーポリシーの変更）

1. 本ポリシーの内容は、法令その他本ポリシーに別段の定めのある事項を除いて、利用者に通知することなく、変更することができるものとします。
2. 当社が別途定める場合を除いて、変更後のプライバシーポリシーは、本ウェブサイトに掲載したときから効力を生じるものとします。

Nonagon Link Privacy Policy

This English translation is provided for reference only. The Japanese version is the official text and shall prevail in the event of any discrepancy.

Nonagon Capital G.K. (the "Company") establishes this Privacy Policy (the "Policy") regarding the personal information of users of the services provided by the Company, including the agentic payment gateway "Nonagon Link" (the "Services"). This Policy explains what personal information the Company collects, how it is used and shared, and how users can manage their own personal information.

Article 1 (Personal Information)

"Personal information" means information about a living individual that falls under either of the following:

• Information that can identify a specific individual by name, date of birth, or other descriptions contained therein (including information that can be readily collated with other information and thereby identify a specific individual)
• Information containing an individual identification code as defined in the Act on the Protection of Personal Information of Japan

Article 2 (Methods of Collection)

1. The Company may ask for personal information such as name, address, telephone number, email address, and bank account number when users register. The Company may also collect transaction records and payment information containing users' personal information from the Company's partners (including information sources, advertisers, and ad distribution destinations; collectively, "Partners").
2. In Nonagon Link, the Company specifically collects:
   • Registration information: email address, password (stored only as an irreversible hash; never in plaintext), display name, and invitation code usage records
   • Provider information: API endpoint URLs and metadata, API credentials (stored encrypted), and bank account information for payouts
   • Payment information: wallet addresses, blockchain transaction signatures, payment amounts, timestamps, and payment status
   • Technical information: IP addresses, cookies and session information, user agents, and access logs

Article 3 (Purposes of Collection and Use)

1. To provide and operate the Services
2. To conclude, perform, terminate, and manage contracts relating to the Services
3. To respond to inquiries from users (including identity verification)
4. To send emails about new features, updates, campaigns, and other services provided by the Company
5. To contact users as necessary, such as for maintenance and important notices
6. To identify and refuse service to users who violate the terms of service or attempt to use the Services for fraudulent or improper purposes (including screening of wallet addresses against economic sanctions lists such as the U.S. OFAC SDN list)
7. To allow users to view, change, and delete their registration information and view their usage status
8. To bill users for paid services and to process settlement and payouts of revenue
9. For purposes incidental to the above

Article 4 (Changes to Purposes of Use)

1. The Company will change the purposes of use of personal information only where the changed purpose is reasonably recognized to be related to the purpose before the change.
2. If the purposes of use are changed, the Company will notify users of the changed purposes or announce them on this website by the method prescribed by the Company.

Article 5 (Provision to Third Parties)

1. The Company will not provide personal information to third parties without the prior consent of the user, except in the following cases or as otherwise permitted by the Act on the Protection of Personal Information and other laws:
   1. Where necessary to protect a person's life, body, or property and it is difficult to obtain the individual's consent
   2. Where particularly necessary to improve public health or promote the sound development of children and it is difficult to obtain the individual's consent
   3. Where it is necessary to cooperate with a national or local government agency or its contractor in performing affairs prescribed by law, and obtaining the individual's consent may impede the performance of such affairs
   4. Where the Company has notified or announced the required matters in advance and filed with the Personal Information Protection Commission
2. Notwithstanding the preceding paragraph, recipients in the following cases are not considered third parties:
   1. Where the Company outsources all or part of the handling of personal information within the scope necessary to achieve the purposes of use (including cloud infrastructure providers such as Amazon Web Services)
   2. Where personal information is provided in connection with business succession due to merger or other reasons
   3. Where personal information is jointly used with specific parties and the required matters have been notified to the individual or made readily available in advance
3. Personal information may be provided to payment processors (such as Circle Internet Financial) to the extent necessary for payment and payout processing in Nonagon Link.

Article 6 (Information Recorded on Blockchains)

In connection with payments on Nonagon Link, wallet addresses, transaction amounts, transaction signatures, and similar data are recorded on public blockchains (distributed ledgers) such as Solana. By their nature, records on a blockchain cannot be deleted or corrected by anyone, including the Company. Please use the Services with this understanding.

Article 7 (Provision to Third Parties Located Abroad)

For payment and payout processing, personal information may be provided to entities located in the United States, such as Circle Internet Financial. For information about the personal data protection systems of the destination countries and the protective measures taken by recipients, please contact us via the contact point in Article 13.

Article 8 (Security Measures)

The Company implements security measures to prevent leakage, loss, or damage of personal information, including encryption of communications (TLS), encryption of stored data, hashing of passwords and Company-issued API keys, encrypted storage of provider API credentials, access controls, and audit logging. The Services use cookies necessary for session management, authentication, and CSRF protection (no cookies are used for advertising). For cookies used for analytics, see the following article.

Article 8-2 (Use of Analytics Tools and Transfer to Third Parties)

1. The Company uses Google Analytics 4, an analytics service provided by Google LLC, to understand and improve how the Services are used.
2. Google Analytics uses cookies (such as _ga) to identify users and collects information including the URL of pages viewed, page titles, referrer, language settings, and device and browser information. To ensure that such information does not contain personally identifiable information, the Company strips all query parameters from transmitted URLs except those beginning with utm_, which are used for traffic-source analysis; replaces the page title with a fixed value identifying the page type; and reduces referrers from external sites to their origin.
3. Information collected under the preceding paragraph is transmitted to Google LLC (United States) and stored and processed on its servers, which may be located outside Japan. This constitutes a provision of personal data to a third party in a foreign country under the Act on the Protection of Personal Information, and the Company makes such provision with the user's consent obtained through the cookie consent banner. For information on the personal data protection regime in the United States, see the materials published by the Personal Information Protection Commission of Japan; for the measures Google takes to protect personal data, see the Google Privacy Policy and Google's data processing terms.
4. Users may withdraw consent at any time from "Cookie Settings" on any page of this site. After withdrawal, transmission to Google stops and Google Analytics cookies are deleted. Users may also opt out of data collection by Google Analytics by installing the Google Analytics Opt-out Browser Add-on. Declining or withdrawing consent does not affect your ability to use the Services.

6. For information on how Google handles data, please see the Google Privacy Policy.

Article 9 (Disclosure of Personal Information)

1. When the Company is requested by an individual to disclose personal information, it will disclose it without delay, except where disclosure falls under any of the following, in which case all or part may not be disclosed, and the Company will notify the individual without delay of any decision not to disclose. A fee of JPY 1,000 per request will be charged for disclosure of personal information.
   1. Where disclosure may harm the life, body, property, or other rights or interests of the individual or a third party
   2. Where disclosure may significantly impede the proper conduct of the Company's business
   3. Where disclosure would violate other laws
2. Notwithstanding the preceding paragraph, information other than personal information, such as history and characteristic information, will in principle not be disclosed.

Article 10 (Correction and Deletion)

1. Users may request the Company to correct, add, or delete ("Correction, etc.") their personal information held by the Company through the procedures prescribed by the Company if such information is incorrect.
2. If the Company determines that a request under the preceding paragraph should be granted, it will carry out the Correction, etc. without delay.
3. The Company will notify the user without delay when it has carried out the Correction, etc. or has decided not to do so.
4. Notwithstanding the preceding paragraphs, information recorded on blockchains (Article 6) cannot be corrected or deleted by its nature.

Article 11 (Suspension of Use)

1. If an individual requests suspension of use or deletion of personal information on the grounds that it is being handled beyond the scope of the purposes of use or was obtained by wrongful means, the Company will conduct the necessary investigation without delay.
2. Based on the results of the investigation, if the Company determines that the request should be granted, it will suspend the use of the personal information without delay.
3. The Company will notify the user without delay when it has suspended use or decided not to do so.
4. Notwithstanding the preceding two paragraphs, where suspension of use requires significant costs or is otherwise difficult, and alternative measures necessary to protect the user's rights and interests can be taken, the Company will take such alternative measures.

Article 12 (Amendments to this Policy)

1. The contents of this Policy may be changed without notice to users, except for matters otherwise provided by law or this Policy.
2. Unless otherwise specified by the Company, the amended Policy takes effect when posted on this website.
